AthenaEventsLtd–TermsofConditions 1.BookingTerms&Payments a. Bookingscanonlybeconfirmedonreceiptofthedeposit(of£10perperson) b. If, inthefirstinstance, youwouldprefertomakeatelephoneenquiry, aprovisionalbookingcanbeheldforamaximumof10days. c. Shouldthedepositnotbereceivedwithin10days, thebookingwilautomaticalybereleased. d. DepositpaymentservesasconfirmationthattheseTerms&ConditionshavebeenreadandthatthepartycontractingwithAthena(hereinafter‘you’)andalguestsagreetoabideby thesetermsandconditions. e. Depositsarenon-refundableinanyeventandpaymentsduecanonlybeacceptedfromyou. f. 1finalbalancepaymentisrequired8weekspriortotheevent. Bookingsmadelesthan8weekspriorwilrequirefulpaymentwithintheearlierof10daysfrombookingortwoweeks beforetheevent. g. Non-paymentofthefinalbalancebytheduedatewilrenderthecontractvoid. h. AVATinvoicewilbeisuedwhenpaymenthasbeenreceived.Aproformainvoicemaybeisuedpriortoreceiptofpayment. i. Thetotalamountdueoneachinvoicemustbesetledwithasinglepayment.Multiplepaymentsarenotaccepted. j. Debit/creditcardpayments, banktransferorchequepaymentsarefreeofcharge. k. Athenaalows16’sandoverintothevenue. However, guestsmustbe18orovertoatendthe‘alinclusive’ evenings. 2.BookingChanges a. Bookingchangesareonlyacceptablewhenreceivedfromyou. b. Placesmayberealocatedshouldapartysizedrop. c. Athenawilendeavourtoaccommodatemenuordetailchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeksbeforethe eventdate. d. Athenaregretsthatchangestobookings, menuchoicesorwineorderscannotbemadeonthedayoftheevent. 3.RefundsandCancelations a. WholebookingcancelationscanonlybemadebyyouandmustbemadeinwritingtoAthenaatitsregisteredofficeofQueenStreet, Leicester, LE11QDorsuchotheraddresthat Athenanotifiestoyouinwriting. Cancelationsoverthetelephonecannotbeaccepted. b. Depositsarenon-refundableandnon-transferableandcannotbeusedforanyothergoodsorservicesprovidedbyAthena(includingbutnotlimitedtothebalancepaymentordrinks orders) c. Refundsofthebalancepaymentwilbecalculatedasfolows i. Refund100%lesdeposit, ifcanceledmorethan56dayspriortoyoureventdate. i. Refund75%lesdeposit, ifcanceledmorethan28daysbutlesthan56dayspriortoyoureventdate. i. Refund50%lesdeposit, ifcanceledmorethan14daysbutlesthan28dayspriortoyoureventdate. iv. Norefund, ifcanceled14daysorlespriortoyoureventdate. d.RefundswilbepaidbyAthenaassoonasreasonablyposiblewithin21daysafterreceivingrefunddetailsfromyou. e. Refundedmonieswilbereturnedviatheoriginalmethodofpayment. 4.Tickets&TablePlans a. YouwilbenotifiedviaemailwhenticketshavebeensentbyAthena2to3weekspriortotheeventdate. b. Duetoon-goingchangesinconfigurations, tableswilnotbealocateduntilthedayoftheevent. c. Shouldindividualplacesetingsberequired, youwilbeabletoalocatetheseduringthePre-dinnerReception, providedthatthisisagreedinadvancewithamemberoftheAthena staf. 5.MenuPre-orders a. Thereisasetmenuforthisevent, withavegetarianalternative.Athenawilendeavourtoaccommodateanyspecialdietaryrequirementsifrequestedinadvance, alergeninformation isheldonaldishesandisavailableonrequest. Athenamustbenotifiedofanydietaryrequirementsnolaterthan2weeksbeforetheeventtothecontactemailaddrespublishedon Athena’swebsiteandinitsbrochurefortheapplicableevent. b. Menuchoicesmustbereceivednolaterthan14dayspriortoyourpartydate. c. Athenawilendeavourtoaccommodatemenuchangesbutwilnotbeheldresponsibleforfailureofanychangesiftheywerecommunicatedlesthan2weeksbeforetheeventdate. d. IfmenuoptionsarenotmadebeforetheeventthestandardChristmasmenuwilbeserved. e. Athenareservestherighttomakechangestotheadvertisedmenuintheeventofshortagesinthesupplyofparticularitemsbutundertakesthatathree-coursemealwilbeserved. f. Whereapartybookingisformorethan1table, pleasenotethat, oncetheguestsareseated, thewaitingstafwilcheckatwhichtabletheguest(s)withspecialdietaryrequirements aresitinginordertoasistwithservice. 6.Beverages a. Anypre-orderedbeverages, drinksvouchersordrinkspackagesmustbepaidforinadvance. b. Anydrinksvoucherspurchasedarenon-refundableaftertheevent, cannotbeexchangedforcashontheeveningandareonlyvalidfortheyearasstatedonthedrinksvouchers. c. Nodrinksareincludedintheticketpriceexceptwherestated. d. Pre-ordereddrinkspackagescanonlybepurchasedifoneispurchasedforeachandeveryguestintheparty.Athenaregretsitisunabletomakeconcesionsforguestswhodonot requirethedrinkspackageforanyreasonwhatsoever. e. Attheevent, anyqueriesregardingabeverageordermustbemadewithamemberofstafatthetime. Weadvisethatyoutakeyourbeverageinvoicetotheeventasproofof purchase. Anyisuesnotraisedduringtheeveningcannotbedealtwithpostevent. f. Guestsmaynot, underanycircumstances, bringtheirowndrinks. g. Athena’slicenseconditionsdonotpermitbeveragestoberemovedfromthevenue. 7.Miscelaneous a. PricesshownwithinthebrochureincludeVATattherateof20%andaresubjecttochangeshouldtheVATratechange. b. Athenareservestherighttorefuseadmision, andtoremovefromthefunctionanyperson, whoseconditionintheopinionofthestafatthevenueinterferes, orislikelytointerfere with, theenjoymentofthefunctionbyotherparticipants.Thisincludesnon-compliancewiththedrescodestatedinthebrochure, onourwebsiteandontickets. c. Athenadoesnotacceptanyresponsibilityinrespectofanypersonpreventedfromenteringthefunction, oraskedtoleaveduetotheirconduct. d. Athenawiltakeeverycaretohonourcommitments-butreservestherighttoamendoralteralorpartoftheprogrammeofthepartiesandregretthattheywilnotacceptliability forerors, changes, omisionsorcancelations. e. Athenadoesnotacceptanyliability&shalnotbeliablefornon-completionoftheevent, orforanydelaysarisingasaresultsofstrikes, riotsorlockoutsafectingtheownerofthe eventvenueoranythirdpartysupplierstoAthenaand/ortheevent, adverseweatherconditions, los, damageorcancelationduetofire, flood, oranyothercausebeyondAthena’srea- sonablecontrol. f. Althoughcarparkingareasarepatroled24hrsadayAthenadoesnotacceptresponsibilityforlosordamagetoyourvehiclewhilstonitspremises. g. DatesandtimingsadvertisedaresubjecttolicensingapprovalandasufficientlevelofticketsalesinthesoleopinionofAthena. h. PicturesusedinthisbrochurearefrompasteventsmanagedbyAthena-exactthemesets, costumesandentertainmentvaryfromvenuetovenueandfromyeartoyear. i. ItmustbeappreciatedthatAthenaisrequiredtobookandpayforlabour, entertainmentandcertainfooditemsinadvance. j. NothinginthesetermslimitsorexcludesAthena’sliabilityfordeathorpersonalinjurycausedbyitsnegligence, fraudorfraudulentmisrepresentation, oranyotherliabilitywhich cannotbelimitedorexcludedbyapplicablelaw. k. Subjecttosub-paragraph(j)above, Athenashalhavenoliabilitytoyou, whetherincontractortortorotherwise, foranylosofprofitorofgoodwil, oranylosordamagewhichis indirectorconsequentialorwhichdoesnotariseasadirectresultandnaturalresultofabreachofitscontractwithyouorwhichisnotareasonablyforeseeableconsequenceofsucha breachandVivid’saggregateliabilitytoyou, whetherincontract, tort(includingnegligence), forbreachofstatutoryduty, orotherwise, arisingunderorinconnectionwiththeprovision ofitscontractwithyoushalbelimitedtotheamountofthepricepaidbyyoutoAthenaunderyourcontractwithVividfortherelevantevent. l. ThesetermsandconditionsaregovernedbyEnglishlawandintheunlikelyeventofadispute, thepartiesshalsubmittotheexclusivejurisdictionoftheEnglishcourts.
